Hi ,
I have an ILR query for which i would be grateful if people can respond, please see my query below.
I am on tier-2 General and I came to UK for the first time on 16-Feb-13 after which my stay in UK is as follows
Date Left to India Date Returned from India Days in India
03-Mar-13 07-Jul-13 126
28-Oct-14 23-Nov-14 26
31-Jul-15 10-Aug-15 10
27-Oct-15 23-Nov-15 27
14-Jan-17 30-Jan-17 16
My queries are as below.
- Will the new rule on 180 days affect me ?
- During those 126 days i was paid in India not in UK, is that a problem ?
If the 126 days is a issue, i will apply on 7th July

You were never out 180 days in any 12 month period so you are fine on that front

Can someone please answer my question. Is it a problem if my company paid my salary in india for 125 days rather than in UK.

Hi All,
I am still awaiting for an answer on this, is it a problem if i was paid in India during the 125 days gap i had in my 1st year of the 5-year count.
Also, will it be sufficient if my employer says that i was out on a business trip during that time.

Hi, It was on the very 1st year and i believe after 3 years you got the successful extension. I.m not any expert but i would suggest you to show that as a business trip as you said..and no need to mention how you were paid on the very 1st year untill or unless they ask you!
They ask for last months pay slip and bank statement only but you can provide latest 3/6/12 months payslip and bank statement .

Tier 2 to ILR - 125 Days Gap

Hi All,
in the first year of my 5 year ILR period, i have a gap of 125 days where i had to travel to India and work at a offshore location and comeback again. What's the best way to address this in the ILR application and do i need to provide any evidence for it. I am thinking to ask My employer to mention this as business visit ?

Hi All,
MY ILR got approved yesterday, wanted to share my experience here so that it will be helpful for others.
Documents submitted:
- SET O Form and checklist
Passport (New and Old)
BRP Card
Passport Photos
Bank Statements and Payslips (5 months)
My UK Msc certificate
Life in UK pass notification
Employer letter (one letter, which mentions my SOC code, salary, absences and confirming that i will be employee for foreseeable future).
Additional documentation i carried, but not submitted
- P60's for last 5 years
council tax bill
utility bills
My appointment was in Liverpool at 10:30am, but i went at 09:30 (as i was feeling bored sitting in the hotel room). They allowed me in.
For the 127 days gap , i asked my employer to mention it as business visit and they added in a statement saying that all business trips are funded by the company.
Also, i had a CCJ, following the advise given on this forum on this topic, i declared the CCJ in the SET O form and also since i cleared the CCJ amount, i obtained a letter of satisfaction from the complainant and provided it as proof.
