ILR Application - Answering question 7.13

Hi,

I am filling out my application for ILR and I am not sure what the right answer for the following question is

7.13 How long have you lived in the UK

I first entered UK on aTier 4 (General) student visa in November 2010 and left for Netherlands August 2011 and came back for a day to submit my project in September 2011 and before I went to Netherlands again.

My student visa expired in November 2011 and I applied for and came to UK again in January 2012 for my Tier 4 Post Study Work Visa. I got my Tier 2 General visa in March 2013 (I applied for it in UK and didn't have to leave country) and have been on it since then.

My question is should I calculate my stay
  • from November 2010 which was when I first entered or
  • from January 2012 or
  • from March 2013

Thats a good question. I have the kind of same scenaito. After completing my masters in 2010 ( i came in 2009) i went back home and come back again with PSW visa in 2013 and get the T2 Visa. So how to calculate the time. Experts please help.

To answer this question (first post) :
I assume you're applying 5 year Tier 2 route. Irrespective of that, I would give Nov 2010. Generally only when you spend more than 180 days outside the UK it is considered as "left the country".

To get a more precise answer, you need to tell us which route you're applying ILR and which form you're using.


Regarding GMO, it should be the date from 2013. Since you were away for longer than 180 days.

I am applying for visa the through the 5 year Tier 2 route and a SET(O) form for the application.

Is this the case even when your visa expires while you are outside the country.
