I was on student visa from 2007 till 2015.
On 2016 i applied EEA resident card .this was refused 2017 January and then I applied FLR(fp) and vary it to ILR on 4 November 2017 and I done my biomatric on December 2017.On March home office refused my FLR(fp) with inside country right of appeal.
They completely ignore ILR application or may be by mistak. My solicitor call and they ask us ILR application evidence and biomatric letter.
I just need to ask what will be the result of ILR .

What was the basis of the EEA Resident Card application? Were you married to an EEA citizen or were you sponsored by an unmarried EEA citizen partner or was there some other EEA citizen sponsor?

It was unmarried EEA partner and this application was refused first time and within 14 days i applied flr(fp) .

When did your Student visa expire??

I apply EEA application before one month of student visa expire therfore i was legal all my previous visa

Why do you believe you were legal???

As an unmarried partner of an EU citizen, you have no automatic rights. You would only have automatic rights to reside if you were married and your partner was a qualified person exercising treaty rights.

Section 3C protection is applicable to UK Immigration rules and not EEA/EU route applications.

Why was your residence card refused??

From the date after your student visa expired, you have no status.

Sorry my student visa was expired on august 2016 then i applied EEA and it was refused on January 2017.
Within 14 days i applied flr (fp).

It doesn't change the fact that you had no status once your student visa expired.

Thanks for quick reply . The Refusal reason was not satisfy with enough evidence .
The last question as I have in country right of appeal on FLR(fp) do you think it will ignore my previous status and help on pending ILR application thanks

Likely your appeal would only consider the time from when you submitted FLR(FP).
