Hi Gurus,
I am planning to apply for ILR on long residency basis. I came on student visa then applied for Tier 1 General in 2011 extended it in 2013, applied for ILR in 2016. Unfortunately, got refusal applied for Admin Review but HO didn’t change their decision (I had tax amendments). In the meantime, my current employer sponsored me and now for almost a year I’m on Tier 2 visa.
My question is if I apply for ILR again on after completing my 10 years would HO ask me about the tax return? Is there any other option I can apply for ILR? If so, what are the chances to get ILR? Would you suggest to stick with Tier 2 visa and apply for ILR on Tier 2 basis?

Many thanks in advance.

Tax amendment issue will lead to refusal under SET(LR) and even potentially Tier 2

Hi Zimba,

Apologies for the delay in getting back to you.

I already have Tier 2, after the HO refused my IRL application, I applied for Tier 2 and was granted in 2017. I'm now on Tier 2. If I apply for IRL again(on long residency this time) would the HO still ask me about Tier 1 tax amendments which were in 2010/2011 and 2011/2012?

Kind regards,
Tauseef

Yes as I said above.
Time spent under Tier 1 needs be lawful and tax amendment is still an issue, so it will certainly lead to a refusal
