Tier 1 Ent to ILR time calculation

Hi everyone.

My question is to figure out how does Home Office calculate 5 years on Tier 1 Ent. while applying for ILR.

After completing initial 3 years i applied for 2 year extension in September 2016
Extension was rejected in November 2016. I sent it for review which was also rejected in December 2016.
Then I made fresh applicationwithin 7 days which was approved in March 2017 and extension finishes in March 2019.

So my 2 year extension started in March 2017 instead of September/October 2016.

So my question is, do I have to wait till March 2019 to apply for ILR or can I apply in September 2018 considering I finish 5 years on this visa in September if I consider gap in between rejection and approval?

Your opinion is highly appreciated.

You do not have to wait, you can apply in Sep 2018 as your 5 years will be complete. Time spent overstaying will be disregarded

Thanks Zimba for your reply.

I have 3 yr old daughter who is also on my dependent visa. Do I have to apply for her ILR too or I can just apply ILR for myself and my partner and then once we have ILR, can I apply fot British passport for my daughter?

If she is born here, she does not need ILR. You can get ILR and then you can register her as BC
