NHS refund after ILR

Hi all,

My wife received her tier 2 PBS dependent visa extension in October 2017. As part of the visa application, she paid NHS health surcharge for the three years visa period. My wife is now applying for ILR (under the 5 year route). Its unclear if my wife can claim refund on the NHS health surcharge amount overlapping between the PBS dependent visa period and ILR.

I note there was a letter posted by UK V&I on 'What do they know' website (under FOI) which stated a successful ILR applicant can claim refund (this is from 2016). However refund guidance on UK V&I website indicates a refund is not applicable in case of visa status changing mid way to ILR from a category where NHS surcharge is payable.

I wanted to check if any other member here had a successful refund this year as I wish to apply for refund after my wife receives her ILR?

You won't get a refund. The UKVI website made it clear:
You won’t get a refund if:

your visa application is successful but you don’t come to the UK
you leave the UK before your visa ends, for example to make a new application
you’re told to leave the UK before your visa expires
you’re applying for indefinite leave to remain or changing to another visa where you don’t need to pay the IHS
