3 days between ILR eligibility and Tier 2 visa expiry

Dear All,

Please consider my situation and kindly advice on 3 questions below. Would be really grateful.

Situation:
First Tier 2 visa granted: 10/09/2013, First UK entry: 23/09/2013
My ILR eligibility (within 28 days before 5 years of visa granted): 12/08/2018
My current Tier 2 Visa expires: 15/08/2018
Wife (came 2016) dependant visa expires: 15/08/2018.

Questions:
1. I am thinking for a premium service ILR application on 13th of August, 2 days before visa expires. Would that be okay?
2. When should my wife apply for Tier 2 PBS extension? After my ILR application or before? If before, on what grounds?
3. Or it's not a risk worth taking and we both should apply for tier 2 extension and I do my ILR application later?

1. Should be fine.

2. Before her visa expires. If she applies by post on the day you (hopefully) get ILR, then no issue. She can also apply in person on the same day but an appointment a couple of hours after yours. HO know the rules!! However, if your ILR fails, her extension application will also fail.

3. Your choice.

Just out of curiosity, I've a question in this case. Does the 5 countdown start from First Tier 2 visa granted on 10/09/2013 or the First UK entry on 23/09/2013?

Thank you CR001. So I guess this is different in case of ILR (LR). If I'm not wrong, for LR, it is counted from the date someone entered in the UK with a valid visa rather when the visa starts for that entry.

Hi QIbrahim,

Just to let you know that your ILR Eligibility date will be 13th August 2018 and not 12th August.

Your 5th Tier 2 Anniversary minus 28 days (10th Sep 2018 - 28 days = 13th Aus 2018).

I know you are looking for appointment on 13th August anyway but still wanted to let you know if you change your mind to book app on 12th instead.
