Hi CR001,
I've got a question while filling online application.
Section 2. Your home and finances:
Current rate of pay: I'm aware 35500 is the eligible rate for applying ILR.
My question is: As per my salary slip if I calculate my "Total Gross Pay" 2958.33 * 12 = 35,499.96 is coming. Is that be ok to apply?

Yes, I posted on 21/06/2018. I've not got reply. That is why I started another thread.
You are 4p short. A member was refused ILR recently for being 60p short.
Can you give me the solution whether can I apply in confidence or should I wait for my next salary hike and apply later?

I'm stressed and confused. Please let me know what is the right way to calculate my annual salary.
When I calculate my monthly gross salary 2958.33*12 = 35,499.96
When I calculate 35,500 / 12 = 2958.33
Which one is correct? Please advice. Thanks,.

Why are you reverse calculating your annual pay? Your actual annual salary should be on your payslip and your P60. You can also download the HMRC app to view your tax record as well as your gross salary.

Thank you for your reply. I'm not able to see the annual salary in my payslip and in P60. When I see in the HMRC app it says
Pay As You Earn
£4553.20(Your PAYE income Tax estimate)
£34,616(Your taxable income estimate)
£11,850(Your tax-free allowance)
1185L(Your tax code)
Can you now tell me the annual salary? Thanks.

Your annual pay is £34,616. Which means you do not meet the salary requirement and your ILR application will most likely be refused. Unless you’ve recently received an increment that HMRC is unaware of.
If you haven’t any bonuses or deductions, that is your actual pay. If you’re still unsure, ask your employer.

I'm more confused now.
My employment offer letter says "You will receive a Total Remuneration package of £35,500.00(GROSS) per."
My employer also said the same.
In my payslip I got below calculations
This period:
Total Gross Pay 2958.33
Gross for Tax 2884.67
Earnings for NI 2955.00
Er Pension 49.11
May I know which one should I consider for calculating my annual salary? Thanks

Echoes, I don't know. My payslip says all this. Too much confusion. I want to know what is the right amount of my annual salary. Please help giving suggestions. Is any number to call HMRC and investigate? Thanks.

You need to have a word with your employer and ask for an explanation. Looks like you’re not paying tax on roughly £1000 of your income per year. You should have a 100% clear understanding of your pay, not only for your ILR application but from an employment perspective as well.
If you are legally receiving some tax free income then it is fine and you can use it to satisfy the income requirement for your ILR application. You must however demonstrate that your total gross income is at least 35500 and your tax affairs are in order.

Echoes many thanks. It's been a year since I joined and I've already filled my appraisal form and discussed about the payrise. My employer said, by this end of June I'll get my payrise and it will be populated in June payslip.
My question is:
1. How soon the payrise will get updated in HMRC system?
2. Can I apply ILR by next month?

1. I think it depends how your company deals with HMRC. My salary is updated with HMRC a week before I'm actually paid. Keep an eye on your online tax account everyday to see if it is updated before your pay day.
2. If you are making 35500 then yes, you do satisfy the requirement. The only concern is, you're not completely sure what your salary is. Normally the annual amount shown in your personal tax account is your salary. But you might be getting more in reality in case you get any non-taxable benefits, such as childcare vouchers etc. Again, your employer would be in the best position to explain what exactly you're being paid.

Your payslips should be stating the YTD figures of your pay and tax deductions, it is standard practice. Suggest look at your whole payslip carefully again.

Hi Echoes, my employer told me that I've not completed one year. That is the reason I'm getting £34,616 in the HMRC app. I'm not sure whether this is true. Can you confirm is this true?

Hi Echoes, my employer told me that I've enrolled in pension scheme. Is that tax free income? Please advice on this.
You mentioned tax affairs are in order. What is the meaning?

That explains it. Pension savings are generally tax free. I don’t see a problem here.

Cool. So, is that the reason it showing £34,616 in HMRC app?
Million dollar question is "Annual pay is calculated by multiplying 12 * Total Gross Pay (or) Gross for Tax"??
Salary Raise not updated

Dear Echoes,
I'm 4 pence short for requirements. My employer said 4 pence shouldn't be a problem. Also, he said increasing 4 pence is not a problem. If he increase in June payslip, does he need to inform to HMRC? How soon he need to inform? Does he need to update in SMS? Will it be a problem? Is that possible? Please advice.

Your monthly income is calculated based on your annual salary, not the other way around. You need to take the annual figure from the HMRC app and find out how much is going to be paid into your pensions for the whole year. Add them together and you should get your annual pay package. This should match the amount specified in your employment agreement.

Annual salary in Employment agreement = £35,500
Annual figure showing on HMRC app = 34,616
Ee Pension every month = £73.66 * 12 = £883.92
So, £34,616 + £883.92 = £35499.92
Not exactly matching £35,500. Is that be OK 1 pence short.? Will it affect? Please advice. Thanks again for your support.
