SET(M) Help - Road Traffic Offense

Hello all,

My wife is applying for ILR (5 year route) end of this month and we'd be very grateful if you can offer some help.

My wife, stupidly, was caught speeding 96mph on the M40 by an unmarked police car back in March. We have received a "Single Justice Procedural Notice" dated 26/06/2018, which although we plan to plead guilty to, have not yet responded to the charge.
How should we fill in Section 9 (Personal History) on the SET(M) form?

9.1. Have you or any dependants who are applying with you ever been convicted of any
criminal offence in the UK or any other country?

Currently I have ticked "No" because technically she hasn't been convicted yet.

9.3. Have you or any dependants who are applying
with you received any other penalty in relation to a
criminal offence; for example a caution, reprimand,
warning, or similar penalties in the UK or any other
country?

Also ticked "No" because technically she hasn't received a penalty yet?

9.7.Have you or any dependants who are applying with you been
arrested and charged in any country with any criminal offence
and are awaiting, or are currently on trial?

Ticked "Yes" as I suppose she has been charged with a criminal offence?


Firstly I would like to ask have I filled it in correctly? And secondly what are the chances her application will be refused due to this road traffic offence? I mean she has been charged (which she will plead guilty to) but she has not yet been sentenced or fined because we haven't responded to the charge.

Hi ,
sorry to hear about this , your wife should have been more careful, anything could affect your application, but hope things would go just fine,
why not take an hour slot with a solicitor and ask them , for sure he/she can help and shed a light on your issue but let us HOPE things would be OK
