Indefinite leave to remain criteria

Hi Everyone,

I have been following this board for some time and you guys are doing an amazing job by helping each other.

I need a bit of your help in order to understand my ILR position before putting in Set LR.

- student Visa stamped 28 Aug 2008
- first entry clearance 24 Sep 2008
- Visa expiry was 28 Dec 2011 but put an in time psw application.
- psw refused on 22 Mar 2012 with right of appeal.
- put a fresh application of PSW on 1 April 2012.
- PSW granted in AUG 2012 to Aug 2014
- got married here and applied FLR(M) in July 2014 and granted until 08 Jan 2017.
- Had issues with wife and she reported me to HO and my leave curtailed on Oct 2016. I was not aware of this. My wife didn't tell me that she did it.
- made a normal application of FLRM on 6 Jan 2017 in time.
- My employer Checked the ECS and he came as negative that the person made a out of time application.
- we wrote to GO and they clarified that curtailment was sent to you in OCT 2016 by email.
- the email home office used was wrong we sent the protocol action and GLD asked me not to apply for judicial review and we are taking back our decision of curtailment and you have put an in time application.
- I developed differences with my wife because of all this and we end up filling for divorce.
- in OCT 2017 before filling up for the divorce I uccessfully varied my application from FLRM TO FLRFP private life.
- on 16th mar I have received a refusal for FLRFP with right of appeal.
- on 26 of Mar i am applying for Appeal.

- I have full working rights till today.

My questions are :

- Is my 3C is continued?
- if continued when should I apply for my ILR 28 days before stamping of visa or entry clearance?
- do you think it's going to be a good idea to go for premium service?

I suggest that you make a Subject Access Request to the Home Office, to see the comments that have been made on your file and more importantly, the timeline of such comments.

Based on those comments, we can advise further.

Thanks for your reply but I have written here is what I got from HO refusal letter. They do send a short history with your refusal letter isn't?
Shall I still order a SAR?

ILR Long Residency & Premium Service Centre

Hi everyone,

I want to know that do I qualify for 10 ILR? My brief history is below:

Student Visa - 24/09/2008 - 28/12/2011
PSW - applied DEC 2011, refused with right of appeal on 24 Mar 2012
PSW - Applied 01/04/2012, granted in Aug 2012 (Aug 2012- Aug 2014)
FLRM - Jul 2014 - Jan 2017
FLRM - Applied Jan 2017 and varied to FLR FP in Oct 2017. FLR FP refused in Mar 2018 with in country right of appeal and court hearing date is Oct 2018.

If I do qualify can I apply through premium service?

You have to withdraw your appeal first and this will end your section 3C protection.

Thank you but do I qualify for 10 year long residency as my period is unbroken and my ten years will be completed on 23 September 2018 and 28 days prior to that will be 26 of August 2018.
