Absence Confirmation Letter - Previous employer

Hi,

I have a similar situation and would appreciate if someone could please guide me?

I have switched 3 jobs on Tier 2 General since I have entered in the UK.
My first & current employers has ready to provided the required letters but my second employer with whom I have worked for 2 years has replied back saying that due to the company policy they would not be able to give any subjective references of my holidays and are ready to give a generic email with basic information.

I have following doubts based on the current scenario:

- What are my options in this situation?
- I read on this thread something about getting subject access request from Home Office confirming the travel history details they maintain to confirm my stay out of UK - Could someone please explain where and how can I get this information?

I would be really grateful if someone who had gone through this situation, could confirm what documents they had provided to match the requirements and if their application was successful.

I'm having a somewhat similar problem with a previous employer except they are ignoring my emails and messages completely. I've requested that they write me a letter and what they need to put in the letter or, if they cannot provide the letter, to write a letter explaining why they cannot provide this information and to provide me with copies of my payslips for my entire employment (and I've included the dates). If they do not do this, I will then make a formal SAR to the company for my payslips which they should still have and will provide the email correspondence with the company to UKVI with a covering letter. I've already detailed out all of my travel for the last 5 years anyways. Lucky for me, I make the 30 days in 12 month caveat where I may not actually need an employer letter (very, very close to it though) but would rather have a letter than not.

If you have spent more than 30 days in a year UKVI will not (highly likely)apply discretion of their ability to ignore the need for absence letter from previous employer.
In fact the ILR checklist states the need for Letters from employers during 5 year period very clearly.

You guys are screwed and you can only pray that your request tbrough (a cover letter) is accepted by UKVI and they apply their discretion to waive the requirement.
