ILR Application Continuous residence broken???

Hi friends,

I need your advice please. I have been legally in the UK for 10 years and I am now due to apply for ILR. However I want to make sure that continuous residence has not been broken. Pleas details below.

- Arrived in the UK: 24 August 2008
- 24 August 2008 to 31 October 2013 - Tier 4 General Visa
- 4 December 2012 to 4 November 2015 - Tier 2 General Visa
- Left the UK on 2nd November 2015 (before Tier 2 visa expired) and re-entered the UK on 31st January 2016 (Tier 4 General Visa).
- 22 January 2016 to 22 August 2020 (Tier 4 General Visa)

I would be grateful if you can please check these dates and see if the continuous residence has been broken. I have not been outside the UK for more than 324 days in total.

Hi,

Thank you for the quick reply. I have another question. My wife is on a tier 4 dependent visa on me. However, she is eligible to apply for ILR in 2019. Can she stay on the tier 4 dependent visa while she waits. The reason I am asking this is because if I apply for ILR, I won't be a tier 4 main applicant anymore.

Please advise.

She should switch to FLR(M) which resets her 5 year ILR clock
