Children benefit and ILR for my son

Dear all,

I am about to apply ILR for my two years old son. Both my husband and I have ILR. After I had obtained ILR, I claimed children benefit for my son and it lasts for several months. My question is will that affect my son’s application of ILR?

No it won't.

Is your child UK born or born abroad?

Why was child not included in parents ILR application?

Thank you so much for your reply. What a release!I was granted ILR last year, my husband‘s application has been pending for a long time and he received his biometric card yesterday finally. My son was born in the UK, we haven’t made any application by now.

We are going to make an appointment at Croydon ASAP. Many thanks again!

Your son doesn't need ILR if you plan on registering him as British. As he is UK born, he has an entitlement to register as British on form MN1 under Section 1(3) of the nationality act and you can skip ILR completely.

It is cheaper than ILR too.

Unfortunately our home country doesn’t allow duel nationalities,so sad...
