Tier 1 general to ilr query

Hi,
I got my first tier 1 general visa on 30/06/2014. I continued with the company until 31st October 2015. I changed job with another employer and on the new cos the start date was 28/12/2015. The gap between two jobs is less than 60 days. With the recent rule changes , can I apply for my ilr in may 2019? Will it still be taken as 5- years continuous employment? Can I apply for ilr in may or it needs to be applied in July?

Also, if I stay with tier 2 general visa for a total of 6 years, do I have to leave the country after 6 years?

I had another query. If ilr gets rejected after applying in may or July 2019, does one need to return back to the country?

Your post is not clear. Do you currently hold a Tier 1 General OR a Tier 2 General???

Also since 30/06/2014, I have gone for holidays once for 21 days and once for 15 days. I am not understanding the qualifying period of 5 years for applying for ilr. Can I still apply in may 2019 for ilr?

Hi

I got my first tier 2 general visa from my first employer in 2014 and biometric card had dates from 30/06/2014 to 15/06/2019. I had to change to another employer. I left the first employer 31st Oct 2015.

My second employer issued a cos where start date was 28/12/2015 and end date 27/12/2018. My tier 2 general visa was issued and biometric card had dates 26/11/2015 to 09/01/2019. My present company is willing to give me another cos for extension of tier 2 general from dec 2018.

I had a few queries and was wondering if anyone can pls help.

1) when I apply for extension in dec 2018, do I have to apply for extension of tier 2 general for 3 years? I had the idea total tier 2 general visa can be for a maximum of six yrs.

2) when can I apply for ilr?

3) can I apply at the end of may 2019 or do I have to to apply after July 2019? I am not understanding when should I apply for ilr and when the 5 year period would qualify?

4) if by any chance ilr is refused, one has to return back to country or can I change to a student visa status? I had entered uk 1st October 2010. My ten years in the country will be by sep 2020.

It would be of great help if any one can pls advise.

1. You apply for 'up to 3 years'. You will likely only get a 1 year or 1.5 year extension so that your total time on tier 2 does not exceed 6 years. How long you get depends on the length stated in your COS.

2. June 2019.

3. You can apply no sooner than within 28 days before the 5th anniversary of your first tier 2 visa start date.

4. If you have a valid visa and your ILR is refused, why do you believe you have to leave the country??
