Dependent child (under 18) VISA process - Query

Hi All,

Good evening everyone. Could anyone please kindly help me with the query.

I have settled in UK (Mid March 2018) on Tier-2 general 5 years route and eligible for citizenship in march-2019.
My wife and elder kid (born out of UK) came to UK in April-2015 on Tier-2 general dependent VISA and they both extended their VISA as Tier-2 dependent in Jan-2016. They are now due for their VISA renewals in JAN-2019.
I understood from UKVI website and forums that my wife's case is straight forward case as I need to apply her VISA under ILR dependent as she didn't complete 5 years continuous residence.
My query here is how should I proceed with my kid's VISA. is he eligible for ILR or still an ILR dependent?
another query is; is he eligible for citizenship once my citizenship application is approved?

This question would have answered earlier but unfortunately I couldn't find the appropriate answer for my case. Please kindly help.

Regards
Karr

The child will follow the same immigration path as your spouse and will need ILR before British citizen can be applied for.

Hi,

Thanks a lot for the kind reply. so for my understanding; they follow the route as:

my wife & kid:
ILR dependent (Jan-2019) + ILR (Apr-2010 (continuous 5 years)) + Citizenship eligibility (Apr-2021)

Though I get my citizenship in 2019 March and I am the only earning parent in the family. I thought once I get my citizenship; my elder kid might be eligible for citizenship.

Thanks again for the kind response. Have a good evening.

Regards,
Karr

No unfortunately it doesn't work like that. Child requires ILR, regardless of whether you work or not or both parents work or not.

Once you are British, they can apply for citizenship immediately after they get ILR without waiting 12 months.

Children born abroad have no entitlement to register as british.

Hi,

Thanks a lot for the kind reply. so the route my kid follow is different than what I expected.

my kid:
a) ILR dependent (Jan-2019)
----------I am eligible for British citizenship in March-2019
b) ILR (Apr-2020 (continuous 5 years))
c) British Citizenship (May-2020, provided he gets the ILR in Apr-2020)

within no time we end up applying for ILR and British passport. And I cannot apply/club my ILR and Citizenship applications also. I must pay for all 3 instances above.

Karr

Wife and child - extension yes.

Wife and child - ILR when eligible.

Wife and child - British Citizenship on form AN for wife and MN1 for child as soon as they have ILR and assuming you are already British at that point.
