Am a dependent of Tier 1 visa holder, my intial visa was issued on 05/12/2013, my date of entry is 01/02/2014. Visa extension was granted and valid until 20/02/2019. my spouse plan to apply for his ILR SET(O) on 6th of December 2018.

1.Can I apply with him on 06 December 2018?
2. Can the absence between the visa issue date and entry date be counted toward allowable absence

I assume you are a PBS dependant of a Tier 1E applicant. The answer to both of the questions is yes

Thanks for prompt response, Am a dependent of PBS Tier 1 investor. Do you mean the rule that state you have to live in the UK with your spouse for 5 years is not applicable for my case.

It does but in Jan 2018 rule changes made it possible to count the time since the visa issue date
