Hi Moderators

My wife came in UK more than 3 months after VISA had been issued. My main question is if the time period between the date when VISA was issued and the date when she physically entered UK be considered as towards qualifying period for settlement purposes?

Here is the timeline

Tier 1 PBS Dependent visa issued on 14/02/2014 expiry date till 26/04/2016 ( date when main applicant tier 1 visa expires)

PBS Dependent entered UK on 29/05/2014 ( 105 days after the visa issue date )

In April 2016 main applicant got ILR via same day Services and afterwards made postal application for extension of PBS dependent visa under Tier 1 dependent category and later got for 3 years

So again the question is if my wife can apply for ILR no sooner than 28 days form 14 FEB 2019 or no Sooner than 28 days from 29 MAY 2019?

Prompt response will be much appreciated

Thanks in advance

PBS dependants do NOT have absence limits when the visa was issued before Jan 2018. So you can assume the visa issue date and apply in Jan 2019
