Private life

Dear members can anyone please guide me on this matter me and my wufe and my son on flr fp (private life) visa granted in August 2018 for 2-1/2 years, but I have already completed 10 years last year and wife and son will complete 10 years in May 2020
My question is if I apply ilr on 10 year , and if I been granted ilr do I need to apply again in new application or they can continue on current visa and when they will complete their 10 year can they apply ilr on that time it’s confusing someone told me if I been granted ilr my wife and son should change their visa as a settled Pearson dependant but Iam not sure
Second question if my ilr application is refused does it affect me and my family visa or we can continue on current flr fp visa

Came in Uk 2007
Got psw visa 2008
Apply tier1 general in 2011
Extension of tier 1 general in 2013
Varied on flr fp visa October 2017 from pending ilr application on tier 1 general
Got refusal on flr fp but HO gave me right of Appeal which they withdraw before hearing and issued me and my family 2-1/2 years visa
I have no gap all this period no 3c broken according to SAR

You are then certainly eligible under long residence but how long your dependants have been in the UK ?

They came in Uk in May 2010
Actually I want to ask about my family if in case i get ilr or in other scenario Ho refuse my ilr application what will be my current visa which is left nearly 2-1/2 year and about my family do they need new application for different status if I get ilr or they can stay in same flr fp visa and then apply LR in May 2020 but their current visa will be expire in March 2021

Your family members will be also eligible for ILR under long residence in May 2020.
So they already have a valid leave until then and therefore they can remain under FLR(FP) until 2020, even after you are granted SET(LR).
If your ILR is refused for any reason, this will NOT affect them at all

One last question please bcz of Tax amendment refusals in different tier 1 general visas I varied on flr fp visa do you think they will look into my tiere status bcz I had then amendments so I varied before decision to avoid 322
Do you think they will refuse it or they will give me right of Appeal in case of refusal even I have a valid visa for more than 2 years

The issue of tax amendments might come up during SET(LR). If you are found to have used deception or declared non genuine income, you will not get ILR. You will get appeal rights if refused. Your current leave will remain unaffected.

In case of refusal they will give me right of Appeal so my current flr fp visa will be valid
