Unpaid Leave Query

Earlier in 2014, up to one calendar month of unpaid leave was allowed for Tier 2 and till Nov 2015, up to 30 days of unpaid leave was allowed.

As per rules exist at that time, employer agreed for 30 days unpaid leave in August 2014 but later on it was changed and now it is up to 4 weeks. Now when ILR applied, does home office checks latest rule or earlier rule matching month?
Also, further leave to remain (visa extension) granted in 2016, does it mean that above unpaid leave was already considered and granted extension?

I see in document as
323AA - "prohibited changes, unless further application for leave to remain is granted which expressly permits the changes"
