ILR for my daughter (6years old)

I moved to UK in May 2015 to work on tier 2 visa along with my daughter (who was 3 years old then). Now i will be eligible for ILR in 1.5 years. My daughter has always stayed with me during this time in the UK. My husband has uk visit visa as he visits us very regulary but living outside uk for job reasons. I changed a few employers since 2015 and whenever i applied for visa, i used to attach legal document with her visa application from my husband from court that my daughter sole responsiblity is with me (mother) and for job reasons he cant live in UK at the moment.
I am so worried now as i have read that to apply for child IlR, both parents should be settled in Uk. But what if i submit a legal document from my husband that i have sole responsibility of my child and she is living with me in UK since 2015.
Can i get her IlR along with me under these circumstances?
