Urgent help required

Dear All,

Home Office gave me time till 11 December to apply visa for my spouse visa.

But the I don`t know in which category I can apply for my spouse visa ( I asked from home office few days ago but they refused to tell in a email reply today.

We both (me and my spouse) applied for my Tier 1 Ent. extension visa in April 2017 and I applied alone (boz. spouse was not eligible for this category as far as I know but not 100% sure) for SET (LR) in July 2018. I also wrote cover letter in which I mention I will apply for my spouse visa after my SET LR application approved. My application was successfully varied in September and enrolled my biometrics in October.

But I receivec email from Home Office 2 weeks before im which they said they wanted to know if I
will be applying for my spouse visa or not (they also claim in an email that they have already sent me letter in September for same thing which I told them I never received) because Home Office said my Tier 1 Ent. application for my spouse is no longer valid as I have varied my application.

Now they gave me extension till 11 December to apply visa for my spouse....

I have few questions in my mind and don`t know what to do.....reply from any guru or other expert can be highly appreciated.

1. Is there any category in which I can apply for my spouse when my SET LR is still pending.

2. Is there any valid visa application for which cost less from others or any valid visit visa ? I don`t know how to explain but my spouse only want to live maximum till april/may 2019 (& don`t want leave UK before that time) due to health treatment and possibly will not be coming (except visit visa)

3. Is there any issue on my application if I will not be applying for my spouse or applying late?

1. FLR(M) if she meets the English and financial requirements. FLR(FP) 10 year partner route if she doesn't meet the requirements. When did or does her PBS Dependent visa expire, presumably she had a tier 1 dependent visa application pending??

2. She cannot apply for a visitor visa within the UK. She only has the two options above.

My spouse came UK as a Tier 1 Ent. dependant in October 2016 (expire in April 2017) and then applied for Tier 1 Ent. extension in April 2017 and was waiting for decision until Home Office email in which they said previous application is discontinued due to my varied application.

She don`t meet English language requirements.

CR001 kindly can you confirm again if she can apply for FLR (FP) (she is in UK for less than 3 years).

As your spouse cannot stay under PBS dependat route you should vary their application to FLR(M) or FLR(FP)
This resets their ILR clock to zero

2. Is there any valid visa application for which cost less from others or any valid visit visa ? No but your spouse will be refused visa and becomes an overstayer.

You should have varied her pending application at the same time you varied yours as there is now a risk she is an overstayer.

If you apply on FLR FP partner route, it is a 10 year route to ILR, 4 x 2.5 year visas, before she can apply for ILR.

Can I still vary her application ? Home office gave me extension and I can apply for my Spouse before 11 December (Monday is last day to apply otherwise they will consider it)

If she is applying for FLR(FP) and told home office to hold her application until my ILR approved then is there any option she can swtich/vary her application with FLR(M). Actually she can`t apply for FLR (M) boz. she is not meeting english language requirement and her passport is with home office so she can`t sit for english exam.

Can I still vary her application ?

Last month Home office sent me email stating that they need to know if I will be applying for my spouse visa or not...they said because I have varied my application so my spouse application is discontinued and home office need to know if I will be applying for her visa or not. If I can vary then I will include a cover letter so that can understand easily.

I wish if I have did this but I have been told by consultant that she can`t apply with you so just told home office to hold her Tier 1 ent. dependant application until my ILR approved.

Dear All,

I have more questions regarding NHS health surcharges payment..........
Is any (extra) payment my spouse need to made for NHS health surcharges whether her FLR(fp) application is varied or not.

She paid NHS surcharges in september 2016 (for 2 year) from outside uk.
Then again paid for 2 years in april 2017 while applying her tier 1 ent. extension dependant application which actually was 3 years payement because they charge for 3 year rather than 2 years. Kindly let me know if I have to pay them again or is there any other way to avoid this payment again, thanks.

if possible can CR001 or Zimba any other expert reply to the post even one-liner will be helpful. my deadline is ending to tomorrow to submit my spouse FLR FP application so any reply will be really appreciated, thanks.

last question.....

I am confused so if any can confirm in which address I need to post FLR (FP) application .......Address on the application form or my Set(LR) application/caseworker address, thanks.
