Divorce as soon as Indefinite leave to remain

Hi,

I am going to apply Indefinite leave to remain June next year and I have 4 year old son between me and my English husband. Our relationship is genuine. However, it’s been so hard to keep the relationship due to his hot temper and abusive language. So I want to divorce as soon as possible after Indefinite leave to remain. Will it affect my rights to stay in the UK? or should I wait until I get British citizenship?

No.

Your choice as you can apply for citizenship as soon as you are granted ILR. All presuming your spouse will support your ILR application.

If u get divorce soon after ILR, u will need to wait for one year for British citizenship. However if u apply as spouse of British national, u can apply for naturalisation on same day of getting ILR. For most of the applications it takes only 4-6 weeks to get passport after ILR.
