Dear Moderators,
Can you please help me out with these queries:

1- Is P46 of an employee mandatory when applying for ILR?

2- If I do not have it and that employee has already resigned, what is the other substitute for P46?

3- Why is UKVI asking for P46?

There is no such requirement under Tier 1E. They have been abolished it 5 years ago !
It is ONLY your RTI submission printouts

Thanks Zimba for your timely reply.

But on filling the online application form, we get this list of documents to be submitted:

Mandatory documents
• The passport issued for XXX
Other documents
• Companies House documentation to demonstrate your registration
• XXX's Life in the UK Test pass notification
• Other evidence of XXX reasons for absences from the UK
• Employee Payment Records, original HM Revenue & Customs P46
• For directors of a company - a printout from Companies House of the company's filing history page and of a Current Appointment Report to show that you are/were a director of each business for the period
• Real Time-Full Payment Submissions
• The language test certificate for XXX to prove the level of English language required
• Evidence of XXX's immigration status in the UK
• Declaration signed by XXX to confirm consent for the Home Office to request verification checks
• Current Biometric Residence Permit
• Documentation to prove the employee was a settled worker for example, the biometric page of a British passport showing the employee's photograph and personal details
• HM Revenue & Customs documentation to demonstrate your registration
• Wage or pay slips to cover total period of employment created for each worker

It is only because when the form asked you that relevant question it gives you a list and tells you to tick only what is relevant. You have ticked that box containing P46 declaring that you will provide it when answering that question so it is showing up in the checklist. I have filled my form also and the checklist did NOT give me any such option.
As Zimba said its NOT required.
You need to “uncheck” that box when you answered that particular question.

One more query:
Will my salary before I get the ILR be taken into consideration if I want to call my family to UK?

Currently they are out of UK.

I do not want to wait for another year after I get my ILR to fulfill the minimum income required to call the family.

I am on Tier 1 Ent Visa.

Any suggestion?

But I want to call my family only after getting ILR.

So for the minimum income requirement, will my salary be taken into consideration that I was drawing before I got ILR?

For a spouse settlement visa you must prove your income at the time of application and you must submit a minimum of 6 months supporting evidence if earnings.

Can this income be in the period of six months in the pre-ILR stage?

I mean, if I start earning the 'required income' from Jan 2019 and get my ILR in June 2019, can I apply for spouse settlement visa in August 2019?

There is NO concept in the immigration rules of 'income before ILR' and 'income after ILR'. Why would you think this even matters?

It is INCOME for a minimum of 6 months with evidence. Different requirements if you are self employed etc.

Hi,
Can anyone please help me out with this query?

The case is Tier 1 (Ent) to ILR.
1- Being the Director of my company is it mandatory to submit my Payslips?
2- Is the Business Bank Statement mandatory or only the letter from bank will suffice?
3- Is it mandatory to submit Personal Bank Statements?

2) either business bank statement OR bank letter is mandatory

There is no such requirement for Tier 1. Also, the online SET (O) form does not ask any finance questions.
If you want to send personal statements thats optional up to you but its NOT required as per the Tier 1 guidance.
Having said that, I answered what you asked if its mandatory. So its not. But personally, I will voluntarily send mine.

No maintenance requirement

Regarding spouse visa, i think either 6 months payslips or saving for last 6 months is required (i dont know the exact amount but i think i overheard it is approx. £14000 and should be in your account for last 6 months). CR001 can tell better.

savings..

There has to be some logic behind that thought coming to you.
May I know why you considered sending your personal bank statements voluntarily, because it is always better to send what is required and not to send extra documents?

That is true.

Background:

The old SET(O) paper form had a finance section 5. It was a generic form but Tier 1 had no option not to fill that. It was unclear if that was needed so members were sending payslips/personal bank statements in support of that.

However, the online form removed the doubts that indeed the finance section is not relevant to Tier 1, hence no personal statements requirement. The online form asks only relevant questions and provides a checklist of documents to include.

If you have a healthy balance to show and you have the bank statements available, I would personally think it would not do any harm so I choose to include.

Why you dont want /or want to send personal statements?

Your reasoning makes sense and I feel it is advisable to send the personal bank statements.

I was not in the favor of sending it as it is not asked by UKVI and sending anything extra may give them a chance to pick out flaws.

One last question:
After filling and submitting the online form, what are the immediate next steps?
Is it required to scan and upload all the documents or do I have the option of sending it by post.
Can the biometrics be done at the post office or do I need to do it via Sopra Steria.

1) You fill the online form. Submit. Pay.
2) You scan and upload all your documents or take the hard copies to the centre for them to scan (at an additional charge) and book your biometric appointment via sopra (you have to do it via sopra now)
