ILR for Dependent

Post by Chait » Tue Feb 12, 2019 4:39 pm

Hi All,

I need experts help to understand if I can apply for ILR for my Wife who is been here in UK since Aug 10th 2012. In total she has been here for 6 Years and 6 Months. Never been away for more than 180 days per year.
The below are the details of my Wife's Visa -
1. She first arrived in UK on 10/08/2012 on Tier 2 ICT Support Partner Visa,
Valid from - 30-07-2012
Valid to - 09-05-2014
I got my ILR on 25-07-2013 So going forward the Visa we went with was FLR(M) which is Spouse/ Partner Leave to Remain.
2. Type of Visa - SPOUSE/ PARTNER LEAVE TO REMAIN
Valid from - 14-05-2014
Valid to - 14-09-2016
3. Type of Visa - SPOUSE/ PARTNER LEAVE TO REMAIN
Valid from - 01-11-2016
Valid to - 08-05-2019
I have got my British Passport i.e. on Dec 7th 2017.

Question - We are planning to apply for ILR and we would like to know if she is eligible or i was wondering a change in the Visa category would have caused new rules to be applied.

Thanks in advance for your valuable inputs.

Sorry my mistake. It's typo

The below should be August not May.
2. Type of Visa - SPOUSE/ PARTNER LEAVE TO REMAIN
Valid from - 14-08-2014

Which makes me think my wife would need visa for few months then ILR.
But shouldn't the clock start from August 10th 2012???

Thanks and I appreciate your responses.

No, it starts from the date the spouse visa was granted, which reset the clock to zero for ILR.
