10 Year Long Residency

Hi Guys,

I have a query regarding my ILR application which i will be applying by end of march. To summarise, i am currently on spouse visa and its valid until dec-2020 but i was thinking of applying under 10 year long residency since i've now completed it lawfully. The only question i have is recently as soon as i finished 10 years in the country i started as self-employed (IT contracting) and was wondering if there will be any issue in my application coz of that?

10 year LR query

Hi Members,

I am soon going to apply for 10 year long residency ILR and i have a final query before proceeding. To brief:

entered uk on T4 and valid from 25/01/2009 - 03/10/2010.
extended T4 from 24/09/2010 to 03/06/2011
PSW from 03/06/2011 to 02/06/2013
Switched to T2 (G) from 28/05/2013 to 28/11/2015 but was made redundant on 20/10/2014 and the employer made UKBA notified but didn't receive curtailment letter until i send them the written request asking for curtailment on 03/02/2015 and then UKBA replied with the letter and setting the date to be 18/04/2015 to re-apply the visa or leave the country.
I then made another T2 application in time on 15/03/2015 with new employer and was granted.
Made FLR(M) application on 20/12/2015 and was granted
Extended spouse visa in June 2018 and is valid until Dec 2020.

So i have already completed 10 years and hence was thinking of applying through 10 year route.

I have SAR and it does reflect the same as i mentioned above and my only query is will this have any negative impact on the long residency application.

One last question do any driving penalties have any impact on ILR ? I had about 6 points back in 2013 due to jumping traffic lights and the licence was revoked as i acquired those points in 1st year of passing my test.

@Zimba, About the driving and penalty points conviction do i need to mention in the application form or should i just say NO ?

agree, but there is this question on online application as:


"Convictions and other penalties
1.At any time have you ever had any of the following, in the UK or in another country?
2.A criminal conviction
3.A penalty for a driving offence, for example disqualification for speeding or no motor insurance
4.An arrest or charge for which you are currently on, or awaiting trial
5.A caution, warning, reprimand or other penalty
6.A civil court judgment against you, for example for non payment of debt, bankruptcy proceedings or anti-social behaviour
7. A civil penalty issued under UK immigration law"

Am referring to point 3 so do i say No or tick point 3 which will then ask me to give the details for the fine and other stuff.

After speaking to a solicitor they said that since its more than 5 years old, we don't have to metnion and since its not visible in the driving licence record now then it should be fine. So just wanted to make it very sure before proceeding.

Only RECORDABLE offences matter (These are serious offences that can carry a prison sentence like drink driving).
If you never been to court or never received a conviction, then ignore it

@Zimba, once last question if for any reason the ILR application has issues which i hope it doesn't with all documents in place but out of curiosity if that's the case will it also cancel my current leave which is valid till end of 2020 ?

No, current visa is not cancelled. It is only cancelled if ilr is granted.
