Help with Job Creation for ILR

Hi Guys,

As I prepare to apply for ILR via 5 Year route of Tier 1 Entrepreneur, I need your help with the issue of Job Creation. Find below what I have prepared and advice if you consider it okay or if otherwise, any advice, please. Got my Tier 1 Entrepreneur Visa on April 11, 2014. Applying for ILR on 14th March 2019

Job Number 1 Created- March 2018
Employee 1:- Employed (Part-time): March 2018 -June 2018 {Total Hours Worked = 397.87}
Employee 2:- Employed (Part-time) : March 2018 -Feb 2019 {Total Hours Worked = 1471.51}

Job Number 2 created - March 2018
Employee 1:- Employed (Part-time): July 2018 -June 2018 {Total Hours Worked = 766}
Employee 2:- Employed (Part-time): March 2018 -Feb 2019 {Total Hours Worked = 822.36}

Basically if you are combining two part timer employees on weekly basis both PT should be min 30 hours a week. If on monthly basis combine both to be min 120 hours/month or to be on the safer side min 130 hours/month.

As per my my understanding of the guidance.
Anything below 120 hrs per month is not considered FT.
The over spill of hours can’t be added to make up the 119.84 to 120hrs
But then I’m not ur caseworker.

How did you calculate the 119.84 hours?
What was the salary paid and what is the wage rate?

Salary Paid was 938.4 and rate was Β£7.83/hour

will you be attaching a wage rate, hours etc change confirmation table? And ur employee is 25 yrs and above?

I have raised my concern with my Accountant and he indeed confirmed that there were mistakes in what he gave me and he is working to correct them and get back to me.

Basically the online form only allows you to mention one wage rate. If your employee had multiple wage rates during your period of claim, its best to draw up a table and upload with your documents or mention in cover letter. As per guidance, you are required to mention all wage rates during period of claim.

Job creation: specified documents.
(c) Confirmation of the employment start date, hours paid per pay period and the hourly rate for each settled worker relied upon to claim points, including any changes in the hours worked per pay period or the hourly rate and the dates of those changes. pg 31

This can be confirmed via the job creation table on the form or if there are too many changes you can draw up a table. This also ensures the caseworker makes no mistakes in calculations.

Your accountant made a mistake in calculating the owed allowances to the employee and submitted incorrect RTI to HMRC.

I am making my application for ILR Tier 1 Entrepreneur Route on 14th March 2019. I need help with checking to make sure all are correct and that I'm not making any mistake or missing out anything/documents, please.

NB 1: Initial Tier 1 Entrepreneur Visa granted = 11th April,2014. Extension granted = 10th November 2017. Due for ILR = 11th April, 2019 But can apply 28 days earlier = 14th March 2019.

NB 2: I have created 2 Full Time jobs (1 Full-time Employee and 3 Part-time Employees)-
Job 1: Admin/Accounts Assistant
Employee 1 = 01-03-2018 to 30-06-2018 (Part-time with an average of 24 hours/week)
Employee 2 = 01-07-2018 to Present (Part-time with an average of 23 hours/week)
Employee 3 = 01-03-2018 to Present (Part-time with an average of 17 hours/week)
Job 2 : Consultant

7. BB statement or bank confirmation letter ( single statement within three months should suffice)

Job Creation:

8. Passport or BRPs of employees
9. RTI (Mar 18 to Feb19).
10.Payslips (Mar 18 to Feb19) for all employees
11.PAYE reference letter (not necessary but if you have it then do so)

4. All of those are optional. The CAR also satisfies 4.
5. Should have been optional - not sure why it popped up for you. Did you join the business ? Or did you have employees before RTI ?
12. Since you have a limited company, the self-assessment letter is not required.

You need to submit one Business bank statement (or letter from the bank).
