Salary Requirement: Temporary Pay Cut

Hello,

I am currently on a Tier 2 visa and have recently reached the date of eligibility for my ILR application. I am currently on the required salary of £35,500 (and was on £35,000 for the three previous months), however, our small start-up company was struggling for a time and I took a pay cut. My most recent payslip shows that my YTD salary is below the £32,500 which was the salary listed on my last visa extension.

I cannot find any information that explicitly says this would be grounds for refusal but I am concerned it will be a problem. I should also mention that my last visa extension was denied as the company's immigration consultant incorrectly listed the contracted hours as 40 instead of 39, meaning I did not meet the salary requirement. The second application was successful but I fear that refusal will be cause for serious scrutiny of the salary portion for my ILR application.

If this WILL be a problem, I wonder if waiting to apply after the start of the new tax year will be a solution as the YTD will start over. I understand I would then need a further pay rise to the new required salary of £35,800.

Any help will be very much appreciated.

You are expected to be the paid the minimum salary as per your COS and any changes must be reported by your sponsor via SMS to the UKVI.
