Hi,

My Mrs is on the 5 year route (Spouse Visa), I wanted to ask when is the earliest we can apply for ILR (FLRM).

Date Visa Issued: 12/03/2014
Entered the UK: 13/04/2014
Date of Current BRP Expiry: 30/07/2019

What date can apply for ILR (28 Days prior), when is the earlier we can apply? is it from the Visa Granted or Arrival in the UK? Can we use the period between Visa being issued and entering the UK towards the qualifying period. As she has only been away from UK 200 days in the whole 5 year period.

It was the fee is non refundable hence don't want to risk it. Can we apply 28 days of her Visa Granted (10/02/2019) or 28 days prior to her Arrival in the UK (16/03/2019).

Thank you.

It makes no difference. HO are aware of the rules and the 28 days early concession.
