Tier 2 to ILR - Calculating Continuous Leave

Hi,

I am currently on a Tier 2 visa, looking to apply for ILR. My job requires me to travel to Europe regularly. I am trying to calculate whether I have exceeded the 180 day rule and need some help.

If I fly out to Germany on Monday morning and return back on Friday evening, does that count as 5 days out of the country or 3 days out of the country?

Also, about the 180 day limit, is it applicable to a rolling 12 month period in my 5 years on the Tier 2 visa or is it applicable to each of the 5 years individually.

Yes it will be counted as three days as the day you left and the day you arrived will not be included

2, it is continuous, consecutive and rolling twelve months, which means they will start counting backwards from the date you qualify for ILR

Thanks for your reply.

Just to clarify, they will count backwards from the date of qualification for five years and Iook at any possible 12 month period within which I must not be out of the country for more than 180 days?
