Traveling while ILR application is still under review

Hi guys,

I am currently in the UK on a Tier 2 work visa (which is still valid). I submitted my application for ILR a little over 4 months ago. My in-person appointment was a couple weeks after that. Everything went smoothly.

I received two emails from the Home Office saying a decision would be made within the 6 month service standard. One was a month after submitting, and the other two months after submitting. I haven't received anything since.

Now, I am supposed to fly somewhere else in the EU in a week, and I don't know what to do. I know that the rules say if you travel outside the UK they will consider your application withdrawn. How do they know that you leave the country? Do they get this information from the Stupid or border security?

Has anyone traveled out of the country while their application is still under review? Would I be foolish to risk it?

I didn't expect this process to take the full 6 months. Is it possible I might get a decision within the next week, or should I not get my hopes up?

Yes, from the Stupid and obviously your return records with UKVI directly.

Yes.

Yes, possible.

Probably not.

By 'in person' do you mean UKCVAS new service or the old Premium Service Centre same day decision service??

Any sudden salary increases shortly before applying for ILR??

What is your SOC??

As far as I can recall, since 2016 HO gets information for traveler also as you came in you have to fill up landing card as well and pass through from immigration. However, this is very clearly mentioned that you cannot travel abroad while your application in process.

Yes, I went through a new UKVCAS Sopra Steria service centre which took copies of my passport and didn't require me to leave it.

SOC is 2429 - Business, research and administrative professionals not elsewhere classified

My salary was 40k when I applied for my Tier 2 Visa, and 44k when I applied for ILR. It is now 48k.

Would they really get the info from my landing card before they have to make a decision (within the next 6 weeks)?

Since they didn't notify me that it would take longer than 6 months, they are required to make a decision within that time frame, right?

Following up on this.

Does anyone know of any case where someone's ILR application has been withdrawn due to traveling outside the UK common travel area?

I still have a value BRP so I wouldn't be refused entry into the UK.

Given the advice, I think you still want to try and see if its withdrawn. Let us know how it goes also 😊
