Need some justification regarding job creation

Dear Marcnath and Zimba and other experts,

Need some justification regarding job creation, I am ready for ILR application.

Jan 2018 to Jun 2018 Business (Restaurant & Event Mgt under same umbrella) was doing ok and looking for better opportunities, business was not excellent coz of location. So this is business A. Business A got 4/5 staff and it was a good team. 4 of them were British settled worker.

July of 2018 in a good location one Restaurent was closing down, So this was business B. They ware struggling coz of good staffing.

Business A moved in to business B. Business A NEVER took over the company but only used the trading name with the written permission of business B’s owner. And gone through new lease and other paperwork. Same time business B closed down their business and Company.

Business B’s all staff got P45 and i have recruited 4 of them ( all British settled) in my company as they know the local business environment very much.

After two month one of my old staff left and which one British settled worker.

Now my question is if I use one of the new staff for my ILR purpose who came from business B would give me any harm? Again - i never took over or joined the company. Only paying for lease, rent and business rate.

NB: Already eligible to apply for ILR from E Visa ( Five years route)

All of those staffs are part timer.

I think ur confusing ur company with the businesses it runs?
If I’ve understood ur post correctly..
you closed down a business running under your company and started a new one.
As long as the employees of business B are on ur companies payroll.. it shouldn’t be a problem.

1.As per ur earlier post, you stated business B was closed down by the owner?
2.Company A is now trading with a new name, which is B?
3.Company A recruited new employees who previously worked for B?
4.Im assuming you have an accountant who must have explained how to sort the above out.
5.If the new employees are on company A’s PAYE and A is still registered with companies house and pays corporation tax, what’s the issue here?
I’m assuming you’ve changed the address of A with
Companies house.
You can also change the name of A to B with companies house in case the caseworker Google’s the business on maps and finds a different name.
You should mention this in a cover letter if you decide not to change the company name from A to B. (Changing companies name is not necessary)
But as far as job creation goes if the above scenario is correct You can safely use the new employees.

Name of the company A is same and will be same just trading name is taken from Business B

Marcnath please please give your opinion regarding my concern as i am going to apply for ILR this week.
