Hi seniors members ,
I am silent reader of this forum last 6 years . This forum helped me aloot , thanks
Now I have query about my ilr application. I need advice from respectable seniors.
I came in the uk on tier 4 visa . I completed my master degree. Then I applied tier 1 entrepreneur 200k£ visa on 12 December 2012.
It was granted on 23 May 2014 after JR. I interviewed as well. On 22 May 2017 , I applied for extension with wife( I have 2 uk born kids, both born after extension application) I interviewed on 22 February 2018 on my shop. I am running a fast food take way shop. Last week my extension has approved . My 10 years have also completed last week. I am thinking for ilr application now.
I decided entrepreneur ilr rout .
I have 2 full time settled employees from 22 May 2017 to October 2018. After that I have 3 part time employees. Only 1 employee is settled.
Can I claim these 2 full time employees???
Can I get required documents list for tier 1 entrepreneur ilr application???
Thanks in advance

No. Those jobs were not created/maintained after extension or within the last 12 months

Just to add what Zimba said:

....or within the last 12 months if your ILR date is less than 12 months from the date of extension.

Hi
I do appreciate it if senior members help me. I’m so confused and two solicitors said totally different things about my situation.
I’ve got tier 1 (entrepreneur) visa on November 2013 and I applied for extension on August 2017 and it’s been approved on 26/04/2019.
From April 2016 till February 2019 I had 2 full time employees but one of them left the company from first of March.
The question is can apply for ILR now?

Thanks so much for helping.

Your situation is very simple. You don’t qualify as per ur job creation situation stated above.

Although you fulfil the continuous period requirement ie 5 years.. you unfortunately don’t fulfil the job creation requirement.
The guidance is very clear on applicants in ur situation ie only the immediate preceding 12 months for Job creation can be considered for assessment.
Let’s say you apply on 15/05/19
Ur job creation can only be considered from 16/06/18 onwards..

Ps. What do you mean when you say only 1 is settled what are the other 2?

It’s probably better for ur family to stick to the Ent route.

Further more you claim:
2 full time employees to Feb 19 where one left on 01/03/19..
So what exactly is the employment situation?
