Can one apply for ILR if he/she has no job for the previous 3 months, but the person has 5 years continuous stay and has not got his visa tier 2 curtailed yet.

You appear to be a tier 2 general visa holder.

So then the answer is no you cannot apply for ILR. To qualify for ILR on tier 2, you must be employed with your sponsor and have the required for the foreseeable future and absence letters. You also need to meet the ILR salary and have evidence of this.
