Application within 28 days prior to 60 months in the UK

Hello,

My wife is on the 5 year route. I was under the impression she could apply for ILR "no more than 28 days before they have completed at least 60 months in the UK". That quote is from this document https://assets.publishing.service.gov.u ... 2.0ext.pdf.

However the immigration rules Appendix FM makes no mention of being able to apply up to 28 days before 60 months are completed (at least not that I have been able to find). Rather, they state:
E-ILRP.1.3. (1) Subject to sub-paragraph (2), the applicant must, at the date of application, have completed a continuous period of either:

(a) at least 60 months in the UK with:
(i) leave to enter granted on the basis of entry clearance as a partner granted under paragraph D-ECP.1.1.; or
(ii) limited leave to remain as a partner granted under paragraph D-LTRP.1.1.; or
(iii) a combination of (i) and (ii);
Can anyone clarify this? I don't want to lose the application fee by applying too early, but I already prepared all the documentation and if we have to wait will have to go doing some of it over again to add the latest months of payslips, bank statements etc.

Nothing has changed in regards to the 28 days before end of qualifying concession from ho.

It is a concession granted by HO not an immigration rule.

Many have done it and been successful, myself included.

Thanks CR001. There's a question in the form "How long have you lived in the UK?". Did you put 4 years 11 months in there? Or 5 years?

Hello,

We submitted my wife's online application for ILR through the online application form yesterday.

I'm confused about the next steps. We have booked an appointment with UKVCAS as required, but the instructions on what we need to do with the documents do not seem clear to me.

Do we scan them ourselves and upload to the website? Are there specific requirements for the type/quality/pagesize of the scan?

Presumably we need to take the originals with us to the appointment. I've read other forum posts saying we need to take photocopies with us too? (and that they will only scan the photocopies not the originals??) If so, are there specific requirements for the type/quality/pagesize/number of the photocopies?

Don't we have to send the originals somewhere? On previous applications we always had to send the originals away.

Any tips would be much appreciated!

Scan the required documents on the UKVCAS website. Take the original with you to the appointment too.
