SET(M)form submitted instead of SET(O) AND is declined and sent to R-LTRP

Hi there,
I got my ILR from Tier 2 general last year and this year my dependents (husband and son) applied for their ILR as their Tier 2 dependent visa will expire next month (July).

We submitted a SET (M) form using Super Priority on 25th April and today 5th June got a letter from UKVI -
you do not qualify for ILR because of Annex A - your previous application was on Tier 2 dependant not on spouse route. You haven't completed 5 year spouse visa to qualify ILR.
However we are satisfied that you would meet R-LTRP so will be granted 30 months limited leave to remain in the UK if you can pay £2000 Health surcharge with in 10 days of the letter.

I think we submitted wrong application, if so what can we do now? Whom should I contact for switching from SET(M) to SET(O) in stead of R-LTRP. My daughter is holding British passport as she born after my ILR.
Do I need to submit a new application? If I visit the UKVI is that going to help?
Any help would be much appreciable.

You will have to reapply on the correct form Set O and likely pay the fees again.

You can't "visit UKVI" offices.

Not sure how you got the form wrong as you were advised in your previous posts that it was form Set O for your dependents.

Many thanks for your reply.

I knew and I filled up that but somehow I routed to a Beta version and it ended up in SET (M). I didn't notice that.

Anyway UKVI is routing my application to R-LTRP, can they switch it to SET (O)? My application is still not refused. But any restrictions to vary the application??

Also even if I submitted a super priority application I got a reply after 35 days - am I eligible to get a refund of my fees? Where should I claim for that?

SET (O) forms 1. Normal 2. Super Priority which way you advise in this case(obviously the fee is too much that's why checking)?

If I reapply - SET(O) my R-LTRP is already there, is there any issue with that?

The flr won't be processed or granted if you do not pay the IHS.

That's true. Now before going- by chance do you know-
1. Any email Id or Ph no to check for any chance of application variation from SET(M) to SET(O)?
2. Any email Id or Ph no for requesting the refund because of the delayed response/outside standard reply for a Super Priority Application?

Did you manage to vary your application from set(m) to set(o)?
I did the same mistake I filled the set(m) form instead of set(o) and I received an email from home office to vary my case to the relevant team so I replied saying I made a mistake by filling set(m) form instead of set(o) form so I requested to withdraw my application or reconsider my application by giving me chance to fill the correct set(o) form.

No, I lost my money. I resubmitted a new application and got ILR.

By the way from where did you submit your application?
Have you got any email Id, could you pass it to me plz? I am still chasing the refund process but no valid contact yet.

I received an email from the case worker saying that the application submitted is incorrect And they gave me an option to vary the case to relevant team. I replied back to them saying I would like to vary the application. I received an email from ukvi@homeoffice.gov.uk

I received an email from home office that my ILR visa under tier 1 is approved.
