I am eligible to apply for ILR soon (10year basis). The only time my visa refused was on

Applied for tier 2 : 25/07/2014
PSW expired : 14/08/2014
Application refused : 19/08/2014
Appeal made on : 02/09/2014
Notice of Hearing: 03/12/2014 at 10am Sheldon Court, 1 Wagon Lane, Sheldon Birmingham B26 3DU
Application made: 01/12/2014
Withdraw: 01/12/2014
Received confirmation from tribunal : 02/12/2014
Application returned as invalid : 05/12/2014
New application made on : 08/12/2014
Application approved : 16/12/2014


In this case have I overstayed at all. Is there a break on my continuous residency?

I appreciate if someone can share their knowledge/experience on the above.

Seems like your last application approved 16/12/2014 and between 25/07/2014 you are not overstayed or continuous did not break. However you should wait for some more experts opinion before apply.

You had no lawful stay between 01/12/2014 and 16/12/2014. As this is belowe 28 days, discretion will be applied
