BRP Renewal

I moved to UK in 2014 under Spouse Visa which was stamped on my passport. I got my Biometric Residence Permit in 2017 and I have never actually realised until today that my residence status on the BRP is "Leave to Remain" instead of Spouse Visa :roll:

My BRP will expire in a few months time and I am at lost as to what is actually the next process. Do I need to complete another visa application form (SET M) or renew my BRP? If I just need to renew the BRP, what is the process and what documents do I need to submit as part of renewal process? I have not done the Life in the UK test yet. Should I do it prior to renewing my BRP?

You have leave to remain under family route. Your BRP simply shows when your current stay expires. You must either extend your stay or apply for settlement (ILR) before the expiry date :!: You may apply for ILR under SET(M) within 28 days of completing your 5 years of lawful residence in the UK. You must pass the LIUK test first before applying for ILR. You must satisfy the English language and financial requirements too.

Thanks Zimba. Very relief to know so that I could start preparing my documents. Can you let me know when is the earliest I could submit my application prior to my expiry date. I am a bit confused about the 28 days period as I thought it takes about 8 weeks for the process. Thanks again.

You can apply 28 days from completing your 5 years
