ILR - 10 year route

I have been living in UK for 10 years and going to apply for ILR. Currently I am in Tier 2 (General) Visa. In 2015 I have been refused for Tier 2 application and got the appeal rights. I have made an appeal for the refusal and during my appeal period I have got another opportunity from a different company and they sponsored me. From this company i have got Tier 2 (General) visa which I am currently holding. My question is that the refusal or appeal period will that be counted in for 10 years ILR route? Thanks.

You should state your full immigration history, visas held, start and expiry dates, refusal dates, appeal date, appeal withdrawn date etc etc if you expect any meaningful advice.

Do you have dependents in the UK??

I don't have any dependents in the UK.

Immigration history
1) Student Visa (Tier-4) - September 2009 to October 2014
2) Applied for Tier 2 in October 2014 and the visa was refused in February 2015.
3) February 2015 appealed against the refusal decision
4) April 2015 Withdrawn the appeal and made a fresh application for Tier 2 with a different company
5) Tier 2 (General) - May 2015 to May 2020

As my 10 year period coming before the Tier 2 - 5 year route, I am going to apply for 10 year route. Could you please let me know whether I am eligible for 10 year route?

Your overstay starts from the day you withdrew the appeal until the day you get the visa. If it is under 28days you have discretion from the HO.

Good luck and please keep updating.

Thanks for that information.

I have withdrawn my application on 15/04/2015 and got my new visa on the 29/05/2015. Which is more than 28 days, is that means that I am not eligible for 10 year route? Please clarify. Thanks.

I think HO might use their discretion because it was before Nov 2016 but please wait for other forum members to advise.

Thanks for the information.

I have made my fresh application within 28 days of my appeal withdrawal. Therefore, it shouldn't come under overstay right? Please clarify.

Periods of overstay will be disregarded between periods of leave if you applied within 28 days of becoming an overstayer and then granted visa later

ILR Super priority service delay

Hi there,

Please see my timeline with regards to my ILR (Set LR) application. I made an application under Super Priority Service.

Application made online: 01/09/2019
Bio-metrics enrolled at Croydon UKVCAS: 02/09/2019

I haven't heard back from the Home Office yet regarding my application. Ideally I should have got an email by next working day, but I haven't received anything on this. Could anyone please let me know why is it delayed?

Is there any way that I can contact them? Please advise.

Please check your junk mail and refresh the email. The yahoo mail was having problems on their server from yesterday until this afternoon.

Good Luck and keep us updated.
