ILR for child born in the UK

Hi,

I have recently been granted ILR. Now I’m applying ILR for my family. I have two children both of them born in the UK. Elder one has a Tier 2 general dependant visa. Younger one doesn’t have any visa. When filling the application form for ILR, what should I mention in the date entered uk? For elder one I mentioned it as the start date of his tier 2 visa. But confused about the younger one. Appreciate inputs on the query.

Why are you applying for ilr for UK born children when you can register them as British?

India doesn’t have dual citizenship if the child has involuntarily become citizen of another country. I didn’t have ILR when the younger one was born so he is not by default British. I want my child to have Indian citizenship and hence the need for ILR.

Note that they only have the option of registering as British as an entitlement as long as they are under the age of 18.

ILR is also not indefinite if they live outside the UK for 2 or more years. They can lose it.

As your younger child doesn't have a visa, you might have to wait till your spouse and older child has ILR on form SET(O) and then apply on form SET(F) for the younger one.

Hi,

Thank you for the prompt response.
Three questions:
1. Is there a reason to not include my younger one in the same application along with my spouse and elder one?
2. Even if I need to make a separate application for my younger one is there a reason to wait till their ILR is approved?
3. Both my children are under 18 and born in the UK. Why is Set O application form applicable for one and Set F for another?

The younger one doesn't have a visa.

Set o applicable for the one that has a visa.

Set f might be easier and can be applied once both parents are settled.
