Tier1 to ILR Application Queries

Dear All,
I hope you all are doing great?
Following is my Immigration history and I am planning to submit my ILR application in the month of June. I would like very much if Senior Gurus including Zimba/CR001 can provide their input and help me this time for a successful application.
My Tier 1 application was approved back in December 2013 followed by Tier 1 Extension approved in November 2017 and valid until November 2019. Since I am eligible to apply for ILR in November 2018 but due to some complex issues, I was unable to submit my application early. I have following question and I would appreciate if you can kindly provide me some advise.
1. Please advise that I am still ok and not late for ILR application as I was eligible in November 2019?
2. Do I require this time to submit my Company Accounts? Two years company accounts was submitted at the time of my Extension application
3. Is this mandatory to submit my Business Bank Statements or Bank letter would be sufficient? I can still provide 1 Month Latest Bank Statement of sufficient? Business is doing well but last few months, I have invested most of my money back into the business and therefore account does not have a strong balance.
4. Do I require personal bank statements?
5. My Wife is my dependent, does she need to appear in B1 English test? We both passed Life in UK Test
Your prompt rely will be much appreciated.
Thank you

First thing I would advise you is to go through the latest Tier 1 guidance as you seem unclear on many points.
Secondly, the most important thing, do you have 2 FT jobs after extension?
Might help:

5) Anyone applying for ILR needs to fulfil LIUK and English B1 or UK Degree requirement.

Is this a real question. You can apply anytime before ur current leave expires. Preferable to apply as soon as possible if you meet the requirements.
2. Do I require this time to submit my Company Accounts? Two years company accounts was submitted at the time of my Extension application
No
3. Is this mandatory to submit my Business Bank Statements or Bank letter would be sufficient? I can still provide 1 Month Latest Bank Statement of sufficient? Business is doing well but last few months, I have invested most of my money back into the business and therefore account does not have a strong balance.
That was the point of the investment. To be utilised towards running of business. Bank letter should suffice.
4. Do I require personal bank statements?
No
5. My Wife is my dependent, does she need to appear in B1 English test? We both passed Life in UK Test
Yes. Read pbs dependant guidance.
Your prompt rely will be much appreciated.
Thank you

You need 2 FT JOBS (not employees) but I would assume you meant the same. Your extension was approved in Nov 2017 so you can claim 2 FT jobs that existed 12 months each after Nov 2017.
Rest read the link above I have given a detailed experience about docs needed.
You will need cohabitation documents for the last 2 years for your wife. English B1 and LIUK both.

Yes, I have two full time employees and that exist for 12 Months each after first extension. However, one of my employee working continuously with me since September 2015 and Second employee joins in January 2018.
My question is in relation to first employee whose details sent during my first extension application which was approved. Since we have to submit RTI/FPS for two full time employees that must show their start date. I am using Payroll Manager and it shows start date only for the first year 15/16 but their after, Start Date does not appear on FPS.
Do I have to print FPS for first employee from the date when she started all the way till the moth I am applying for ILR along with second full time employee? I am assuming that I should send FPS/Payslips for the following months;
First Employee RTI to Submit
- Start Date: September 2015 - April 2019
Second Employee
- Start Date: January 2018 - March 2018
- Resigned: April 2019
Please advise
Thanks

There is no requirement to show start date on FPS anymore. The rule has changed. You dont need to send in any evidence for the employee working since 2015. You only have to send the 12 RTI FPS you will be claiming for. 2 FT jobs for 12 months each after extension. Thats it. You seem to have way more months, anything additional will be just extra.

Dont send any FPS before extension. Its not needed and u cant claim points for it. It will only confuse the CW unnecessarily.
All you need is 2 FT JOBS that existed 12 months each after extension. So you need 12 months of RTI FPS but always best to send some extra months if you have just incase.

Well noted your instructions for second point with thanks. However, I do not exactly understand when you have stated, "

Quoting yourself: “First Employee RTI to Submit
- Start Date: September 2015 - April 2019”
Dont send FPS from Sep 2015 - Nov 2017. Its not needed and you cannot claim points for it.
Only send relevant FPS after Nov 2017(that is after your extension).

Great help and as long as Start date on FPS does not required any more then I am happy to submit FPS's starts from November 2017 - January 2019 (2 Months extra just in case) is this ok?

Only after Nov 2017 is required. Its up to you how much you wanna send extra on top of it. 2 months extra seems logical. How many hours does your payslips show every month?

Second Employee 30/hrs per week, 130 hrs/Month and she is on minimum National Wage

What does your first employee salary slips show? Do they show the monthly hours? Do you pay weekly or monthly basis?

I just cross checked with Guidance and it stated the following;
(c) Confirmation of the employment start date, job title, job description, hours paid per pay period and the hourly rate for each settled worker relied upon to claim points, including any changes in the hours worked per pay period or the hourly rate and the dates of those changes.
They are asking for employee start date?

Yes you will declare that in the application form. Its not needed on the FPS anymore.

Only 30 hours/week will be counted. Rest will not be of any use for points scoring. As long its 30 hours/week or more its okay.

In addition to the above, I see that From 29th March 2019 two additional things are needed:
1) Director job/role description
2) Employee job role description
Where do we add these details? Please advise. Thanks

Contracts are not needed. Dont provide HO with unnecessary info. Contracts were not needed even at extension stage.
Just simply state on an A4 size page. Keep it simple and short.

Hi Zimda & Other Seniors,
Since I am very closed to apply for ILR (5 years route) early next month and I would like your advise on FPS.
In my last experience when I have applied for T1 Extension application and it was approved in November 2017, there was a debate on Start/Finish date that must be on FPS and therefore I used Money Soft to do this job for me by using Payroll information provided by my accountant. I have following queries for my ILR application;
1. This is not just a rumour that start/finish date is no longer required by HO on FPS? Please advise
2. My accountant is using eSlip Payroll system and the doc provided including Full Payslips (Shows Hours of worked, Pay Rate), HMRC Remittance Report (Total Tax and NI Due this Period) and Payroll Summary (Gross/Net Pay and showing all deductions) looks the same as Moneysoft RTI. Since it does not state RTI (FPS) on the documents neither start/finish date of employees, please advise if these documents are sufficient and meet the requirement
3. In my previous T1 extension application, I have used Money Soft due to the above reason. I am honestly speaking struggling with Money Soft this time as most of the months figures does not matched with the payroll given by the accountant. Please advise what to do
I hope to have your prompt response on the above mentioned queries.
Thank you
