How soon can I apply ILR after switching tier 2 employer?

Hi All, I hope you could help me with my questions.

I have my tier 2 visa granted starting from 12 Nov 2014.
I can apply for an ILR (5 years route via tier 2) on 15 Oct 2019.
However, I have a job offer from a company I would love to work with which I agreed to start no later than 1 Nov 2019.

I have 2 choices:

1. Stay with my current employer and get ILR with them (they know about my offer and agree to help). However, submitting the ILR application on 15 Oct 2019 means that I might be granted ILR later than 1 Nov 2019 though I will choose premium service.

2. Get tier 2 visa from my new employer with start date 1 Nov 2019 and apply ILR with my new employer.

If I go with option#2, how soon can I apply for ILR with my new employer?

Thank you very much for your help.

You cannot get ILR unless your employer gives you a letter that they need you for the foreseeable future. I assume your current employer will refuse to give you that if they know you are moving on. You need to switch employers first and get a new visa and then you can apply for ILR immediately afterwards given all the other conditions are met.

Hi Zimba,

Thank very much for your quick reply.

My current employee knew that I will be leaving but agreed to issue that letter.

Anyway, I will probably go with option#2 as I have no idea how long does it take to get ILR.

Thanks so much for your help.

Salary increased 5 months before eligible to apply ILR (PhD level)

Hi All,

My job and its SOC code is classified as PhD level jobs.
I'm due to apply for an ILR in the mid of October.
My salary was 35K for slightly over 1 year since joining the company and, in June, my salary has been increased to 45K in which my employer reported into the SMS system that 'salary increased due to performance and duties'.
Since my job is a PhD level job, which is subjected to salary exemption, will this raise a suspicion to the HO?
Any comments?

Thank you very much.
