Tier2 Genaral to ILR (45Days shortfall) 5year route

Hi all.

I have entered UK on 28/03/2019 on Tier2 General Visa (Skilled migrant/Shortage occupation job).

Date of Issue of Entry clearance was 25/02/2019.Tier2 visa is valid till 14/02/2024.

I'll finish my 5 years residence in UK on 28/03/2024.Whereas my Tier 2 Visa valid till 14/02/2024.I'll have a shortfall of 45 days for 5 years residence in UK.

In order for me to qualify for 5 year ILR route, do I need Tier2 visa extension in Feb 2024 for one more year or I am eligible for ILR to apply for ILR 28days before 14/02/2024.If I am eligible, when can I apply for ILR.

Your kind help & views will be highly appreciated.Thanks alot for making such a wonderful forum here.

As the rules stand now, you would qualify for ilr no sooner than within 28 days before the initial visa ISSUE date.

I understand from your post that I can apply for ILR on Tier2 5year route within 28 days before Date of Issue of T2G Visa i.e on 28/01/2024.But my Visa is valid till 14/02/2024.

You mean to say that I do not have to worry about 45days shortfall as I finish my residence in UK on 28/03/2024.Sorry for this Qs again as I'm confused.Thanks for your time.

It starts counting from visa issue date. You need a valid visa at the time of applying.

So you mean to say here that I can still apply for ILR without completing 5 years full stay in UK on T2 visa as long same as the Visa is valid.But I have one question here.

In my case I count the 5 year period from 25/02/2019 & that ends on 25/02/2024. I still have 30 days short to 5year ILR route that the Anniversary is on 28/03/2024. Is that right?

Can I have your view on this.Thanks for your precious time.

If your visa was issued on 25 Feb 2019, you can apply for ilr on 25 Feb 2024 minus 28 days. It is not based on the date of entry to the UK.

The 28 days before is a concession for all routes given by ho and they do actually know the rules.

But one last Q here.28days before 25/02/2024 i.e on Sunday 28/01/2024 I can apply for ILR. In this case, I still fall short by 11days to complete 5year Residence as current T2G Visa expires on 14/02/2024.What to do in this case.

You really are confusing yourself and overthinking completely.

You are allowed to apply within 28 days of the 5th anniversary of your visa issue date. Not sure how much more clear I can put this or what it is exactly you do not understand.
