Clarification on Appointment Date vs date of decision

Hi,

Wanted some clarifications with regards to 'Application date' and 'Date of decision' just to assess that I am ok with regards to my ILR application

Start date for current Tier 2 general visa: 5th Sept 2014
In between changed employer and got another T2G visa, start date for current visa: 9th Sept 2015
End date: 14th Sept 2020

I am eligible for ILR and working backwards 28 days from 5 year completion date i.e. 5th Sept 2019 its 8th Aug 2019

I have submitted the application form on 2nd August 2019 and took the Biometrics appointment for 15th Aug. No documents uploaded or submitted so far in the portal. I have taken the super-priority appointment i.e. same day

Going with the guidelines from Home office:
Applicants can submit a settlement application up to 28 days before they would reach the end of the specified period.
You must calculate the relevant qualifying period by counting backward from whichever of the following is most beneficial to the applicant:
• the date of application
• the date of decision
• any date up to 28 days after the date of application


what is the date of decision - appointment date or date of document submission in the portal?

Assuming date of decision will be the appointment date or later and 15th Aug being later than 8th Aug will be within the 28 days count, I believe my situation to be ok as far as guidelines are concerned.

The experts out there - please can you confirm?

Hi,

Just for clarity its not the 2nd Aug 2019 but the day when i will be submitting the docs prior to appointment date on the portal? Please can you advice?

The date of application is the date that you submit and pay for the online application. It is not the date of your UKCVAS (third party agent not HO) appointment.

Hi CR001,

My question is - what is date of decision? As that will be favourable to me because the date of application 2nd Aug is outside the 28 day window. Looking into my original post please let me if I am ok and which day will work in my favour?

Date of decision is the date HO makes a decision on your application. No one can tell you when that will be or how long HO will take. Super Priority is not the same as the old 'premium service centre same day'. Super priority is 24 hour decision but it is not guaranteed either. You don't get a decision at the centre while you wait.

So in my case decision date will be always on or after the biometric appointment date (15th Aug 2019) as the decision cant be taken before that. With that logic I will be within the 28 day period as 28 days from t2g start date is 8th Aug 2019 and 15th aug is after 8th Aug. Please help in clarifying this aspect? Thanks

Hi,
I have my ILR biometric appointment on 14th Aug. I am applying alone however in the main application I have said 'YES' for the question - Is the account with a bank or utility company for which you have supplied information and supporting documentation held jointly by you and other people?

Reason - I am submitting council tax statement for 5 years to prove the continuous stay and my wife's name is also there in the council tax bill.

I will include marriage certificate as well in the uploaded documents under 'others' category, My wife has signed the PART B of the consent form too.

My question - Does my wife need to be physically present too during the appointment on 14th or the signed, scanned and uploaded PART B of consent letter will suffice? Please note the confirmation email from UKVI says - You should arrive at your appointment in good time and bear in mind that space is limited and only those required at the appointment should attend.

Please help me with this query?

CR001 - i am facing problem in accessing the previous email id and can't remember the long reset password that i got yesterday after password reset hence logged in using another id. no wrong intentions sir.

As i said I was not able to recall the long password and had to post this query urgently. Apologies I was not aware of multi-user condition. I have no intentions to violate any of the forum laws. Please help me with the query CR001. how the previous login is showing I am really unsure. I really need to know the expert opinion and accordingly, need to make plans. Apologies again of the inconvenience if I have caused any.

Hi, I have been granted ILR a day after my biometric appointment date. As my application date (online submission and HO fees paid date) was a couple of days outside the 28 day period but the appointment date was within, the decision date (which is always after appointment date) is important for the calculations. So in my experience, you can submit the application before the 28 day window but make sure the appointment date is within and all your documents are correct. Although during the Biometrics the staff at Sopra Steria only checked the legibility of the already uploaded documents and took the passport and biometric card scan with multiple time finger print scans as there was some problem with the machine. My appointment was at 9:30AM and I got the decision email next day 1:34PM. Anxious moments in between :-
