Tier 2 to ILR - Employer letter and dependant application

Hi all,

Have scoured the boards but haven't found anything specifically addressing these two questions. My dependant and I will be applying for ILR in a few days.

1) At the moment, my employer will provide me with a letter of support that checks all the needed boxes EXCEPT that rather than specifically saying "forseeable future," its states that my contract runs "until March of 2021 of with the possibility of further renewal thereafter." Is this an issue? Obviously to my eyes that's the foreseeable future, but if anyone can point to accepted/rejected cases with similar wording it'd be appreciated.

2) Does my dependant NEED to apply for ILR at the same time as me? Or will their PBS Dependant leave (which is ongoing for another year) remain valid if I obtain my ILR, and then they can apply a few months from now? My preference would be to get my ILR first, then do theirs a few months from now, in case of the nightmare scenario of the application being rejected.

1. Might be ok. Some members have had success without the specific statement but cannot recall if their contract had an end date that was stated.

2. Dependents can apply at any point before visa expires. Remember that fees increase beginning of April each year.

Thanks for your response Char. Just to clarify - there are no immediate requirements for the PBS Dependant visa holder to do anything, even though my Tier 2 visa would be superseded by my ILR (and even though they COULD apply for ILR at the same time)? No need for my dependant to switch to some other visa category? Had always thought that the PBS Dependant visa was linked to that Tier 2 status.

Also, if anyone has experiences with similar employer letters outside of the normal provided template, good or bad, please do chime in!

Nothing that needs to be done. The rules permit them to stay in their current visas if you get ilr based on tier 2.
