ILR for indian born kid for Tier1 PBS Dependent spouse and ILR parent

Hello all,

I am into a weird situation could not find any favorable answers for question, so i resort to immigration board for a definite answer so that i can save $$$$$$$.

Main Applicant : Tier 1 General HSMP
ILR date : 09/2014 ( Still on ILR)

Spouse visa : Tier1 General Dependent (PBS)
Arrival in UK : 09/2012
Extensions : 2014, 2016 , due to expire in 12/2019
She is now eligible for ILR - 5 years in U.K

Dependent Child1 : Tier 1 General Dependent (PBS) - Born in India
Arrival in UK : 02/2014
Extensions : 2014,2016, due to expire in 12/2019
She is now eligible for ILR - 5 years in U.K

Dependent Child2 : Tier 1 General Dependent (PBS) - Born in India
Arrival in UK : 07/2017
Extensions : None ( visa applied from India)
She is only in UK for 2+ years

Can some one please confirm whether my understanding is correct or not ? Main applicant (me) is already on ILR.


1. I can file ILR for all of my dependents in one go ?
2. 180 rule does not apply to PBS dependents whose leave is granted before Jan 2018.
3. I am using SET(0) for ILR.


I am planning to submit the following evidence :

1. Life In U.K test certificate
2. UK NARIC confirming the degree equivalent to U.K bachelor degree and taught in english. We went through RED route, we got both certificates.
3. JNTU OD for B.Tech
4. Medium of instruction letter from College.
5. Maintained 5k funds for 3 months.

I am planning to submit the following evidence :

5. There is no maintenance fund requirement for ilr.

You also need evidence of cohabitation in joint names for the last 2 years.

They could have applied for ilr in 2017 already.

Thank you very much for the quick reply.

We have to apply the second extension early by six months in 2016 due to our second child. So she applied second extension early and went back to India for delivery.

They could have still applies as soon as they returned to the UK.

Had the child been born in the uk, the child would have been automatically British and could have applied for a British passport directly.

ILR granted for all dependents .

Thanks every one for your help. Right to work won’t be true all time , especially for those who got the initial visa from India and subsequently got the BRO in UK
