Gaps In 10 Year Stay

Dear Gurus,

On behalf of my friend I would like to request you (especially Zimba) to help me on the below question, which is related to the gap in his stay in UK.

"My first visa was ICT Short Term having validity from 11/12/2011 to 10/12/2012 on which I travelled to the UK on 02/01/2012 and left the UK on 08/12/2012. After my return, I come back UK on ICT Long Term on 24/02/2013 having the gap of 77 days exact between my UK exit on short term and entry on the Long term. The long term visa validity start date was 19/02/2013 and the application for this Long term visa was made on 04/02/2013. I will be very thankful if someone can help me to understand that for 10-year root, my this first year of stay will be considered or not"

If you leave the UK with a valid visa and return within 6 months with a valid leave again, your lawful residence continuous
