Hi Gurus,

In the next 2 weeks I already have an appointment booked and am applying using SET(M) for ILR under 5 yr parter route of British Citizen who settled on a work visa.
During the last 3 months I applied and claimed for 30 hours free child care funding, which we as working parents are eligible to apply. But instead of my partner who is a british citizen, i made the application and subsequently used the funding code.
Now following up since my application i realised that the 30 hours free child care funding application should have been made by my british spouse and not me.

Please can someone let me know:
Is this going to negatively affect the outcome of my application? If so what are the possible remedial route.

Has anyone experienced any thing similar.
Any advice would be much appreciated.

You breached the condition on your visa which does NOT allow you to have access to public funds. It is up to UKVI to decide how to proceed. I suggest to contact DWP and seek their advice. They may ask you to return the benefits you received.

Many thanks for your reply. I am now in touch with the child care team to understand the next steps. I have already submitted a form correctly filled in to reconfirm my details and response. It seems that they do their checks before confirming the eligibility. In my case did they confirm the eligibility after looking at my partners British citizenship, I don't know. I have offered to pay back the claimed amount which I will have to wait and see what they come back with and when.

Please anyone have any other experience or suggestion.

I have come across on the forum about previous cases where application rejections have happened but never across one which says rejection happened as a part of SET(M) application.
