Hi all,

I applied for ILR set (O) via Tier 1 entrepreneur in August 2019 and hoping to get approval in January or February 20202.

My kids have all been my dependants from feb 2014 when I got my initial leave to remain as T1E, however my spouse became my dependant in May 2015.

I am confused as to when I can apply for ILR for my kids. Their current leave to remain expires in February 2020.

Questions:

1. Can I apply for their ILR when my gets approved?
2. If I am not able to apply for them, then what visa application can I make for them when their current leave expires.
3. When does my spouse qualify to apply for ILR?

No, they will qualify to apply for ILR when your spouse does.

Tier 1 Dependent extension.

3. When does my spouse qualify to apply for ILR?

No sooner than within 28 days before the 5th anniversary of the initial Tier 1 Dependent visa issue date. What was her visa category before becoming a tier 1 dependent?

My spouse was 1st my dependant when I had PSW visa, then switched to Tier 4 visa while I went for T1E and then became a dependant again in 2015.

Thats a shame, as had she remained a PSW dependent, she could have applied.

Does she have almost 10 years residence for ILR LR or not?
