Absence Period for Dependent of Settled person- non tier

Hi,

My husband got his ILr in year 2012 on work permit route. I got married to him in Feb 2014 and got dependent spouse visa on April 2014 for approximately 2 years 10 months . Again I applied for extension of spouse dependent visa and got visa in march 2017 . I got spouse dependent visa of total 5years 7 month which expires on 7 /12/19. Both the time , I applied for visa from outside the UK? Before second extension, when my first visa was about to expire in month of December 16, I Ieft Uk for my brother's wedding and applied extension in month of February 17 & got spouse dependant visa in month of march 17.
Secondly, during first year spouse visas, i.e., 2014-15, I spent approximately 6 month 25 days outside Uk , half of these holidays were in year 2014 & other half were in 2015.
Thirdly, I took a long leave of approx 6 month 6 days from in year 2017/18 which are spent outside UK. Half of these are in 2017 & other half in 2018. Now I am planning to apply for SET M , IlR spouse dependent visa in Nov2019. Now I have few questions ?

1. Do the break between two visa extension can cause any problem?
2. Do the new absence period rule which is introduced around 11 January 2018 or any other absence period rule will apply on dependent of settled person( work permit route & got ILR in 2012)?


Hopefully I have explained my case well. Any help will be great help. Thanks in advance.

Family/Spouse visa holders have NO absence limits. Do NOT confuse your case with point based dependant rules :!:

when my first visa was about to expire in month of December 16, I Ieft Uk for my brother's wedding and applied extension in month of February 17 & got spouse dependant visa in month of march 17.
What date did your first visa expire exactly??

Sorry I gave a bit wrong information. My visa was about to expire on 27/12/16 & I applied for the extension on 18/12/16 before the date of visa expiry and I got visa on 7/3/17. During this time I was outside of UK

Second Spouse Visa Extension from Outside the Uk

Hi,

My husband got his ILR in 2012. I got married to him in 2014.
First Spouse Visa issued from my home country for 2 years 9 months. Issued on 27/03/2014 till 27/12/2016.
Second Spouse Visa I applied again from my home country, I applied before the expiry of my first spouse visa. Date on which I applied for second spouse visa is 18/12/16 and I got my second visa on 07/03/2017 till 07/12/19. which is again valid for 2 years 9 months. I believe since I am dependent on Settled person therefore absence due to holidays does not apply on me, correct me if I am wrong. My questions are:

1) Does Second spouse visa extension from outside the UK breaks your continuity for ILR though I have travelled to my home country on valid UK visa and applied before the expiry of present visa?

2) If there is any such rule then kindly please provide me the link for this guidance.

Much appreciate any help as this is quite crucial for my application. Thanks in advance
