Hi,

I came to UK on a tier 2 spouse visa and later switched to dependent /spouse visa for a settled person in 2016 as my husband got his settlement.

Recently due to personal circumstances, thing have changed between me and husband and I am thinking of Filing for separation and maybe later divorce him if things doesn’t change. Can you help me in finding if I can qualify in applying for a settlement visa in any ways considering I have lived in uk on two different visa for over 6 years now, my current visa (spouse/dependent to a settled person) is valid until November 2021

I am a good resident and have been working in this country (UK) for over 4 years now and don’t wish to relocate again and start from scratch as now I have work and friends all based in UK.

You only qualify for ilr in 2021, once you have 5 years on your current visa. PBS dependent visa time cannot be used to make up 5 years.

So you have children in the UK?

You would have to find another visa you can apply for and will lost likely have to apply from home country. Note that kit all visa qualify for ilr based on 5 years. However all visa count for ilr based on long residence ilr.
